SMS Terms & Conditions

These SMS Terms and Conditions (these "SMS Terms") govern your participation in the Buy A Star Foundation text-messaging program (the "Program"), operated by Buy A Star Foundation ("we," "us," or "our"). By opting in to the Program, you agree to these SMS Terms, our Terms and Conditions, and our Privacy Policy.

1. Program Description

The Program delivers text messages from Buy A Star Foundation to subscribers who opt in. You may receive:

  • Transactional messages — order confirmations, Certificate delivery notifications, payment receipts, customer-service replies, and similar order-related notices.
  • Marketing / promotional messages — new-product announcements, special offers, promotional codes, sale events, holiday and gifting reminders, abandoned-cart reminders, and similar marketing communications.

2. How to Opt In

You may join the Program by:

  • checking the SMS opt-in box at checkout or signup on buyastarfoundation.com;
  • texting a keyword (e.g., JOIN) to our short code or long code when offered in a promotion; or
  • providing express consent through any other clearly disclosed enrollment method.

By opting in, you represent and warrant that:

  • you are at least eighteen (18) years old (or the age of majority in your jurisdiction);
  • you are the subscriber to the mobile number provided, or you have express authorization from the subscriber to enroll that number;
  • you consent to receive recurring text messages sent using an automatic telephone dialing system or other automated technology; and
  • you understand that consent to receive marketing messages is not a condition of any purchase.

3. Message Frequency

Message frequency varies, but you should expect approximately three (3) to five (5) messages per month, with possible additional messages tied to specific orders, seasonal campaigns, or replies to your inquiries.

4. Message and Data Rates

Message and data rates may apply. All charges associated with text messaging — including for receiving, replying to, or forwarding messages — are your responsibility and are billed by your wireless carrier under your individual mobile plan. We do not charge a fee to participate in the Program. Check with your carrier for plan details.

5. How to Get Help — HELP

For help, reply HELP to any message you receive from us, or contact us at support@buyastarfoundation.com.

6. How to Cancel — STOP

You can cancel the Program at any time by replying STOP to any text message you receive from us. After you send STOP, we will send a single confirmation message; you will receive no further marketing or recurring messages unless and until you re-enroll.

If you have enrolled in more than one Buy A Star Foundation SMS list or program, you may need to send STOP from each enrolled number to cancel each program separately.

You may also request opt-out by emailing support@buyastarfoundation.com with "SMS STOP" and your mobile number in the subject line.

7. Supported Carriers

The Program is supported on most major U.S. wireless carriers, including AT&T, T-Mobile, Verizon Wireless, Sprint, Boost Mobile, Cricket Wireless, U.S. Cellular, MetroPCS, Virgin Mobile, and many regional carriers. Supported carriers may change without notice.

Carriers (including, without limitation, T-Mobile) are not liable for delayed or undelivered messages. We are not responsible for any delay, failure to deliver, or misdirected delivery of messages caused by your carrier, your device, network issues, or any other circumstance outside our reasonable control.

8. Mobile Number Changes

If you change or deactivate the mobile number you used to enroll, you must notify us promptly at support@buyastarfoundation.com and either update your number or opt out of the Program. You agree that you will not hold us liable for messages sent to a number you no longer control if you have not updated your enrollment.

9. Privacy

We collect, use, and disclose information collected through the Program in accordance with our Privacy Policy, which is incorporated into these SMS Terms by reference. We do not sell your mobile number or message content to third parties for their independent marketing purposes. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.

10. Eligibility

The Program is open to subscribers of supported U.S. wireless carriers who are at least eighteen (18) years old. The Program is not available to subscribers under the age of 18 or to individuals located outside the United States.

11. Disclaimer of Warranties

The Program is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that messages will be timely, accurate, complete, or error-free.

12. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any failed, delayed, misdirected, or undelivered messages; any errors in messages; or any action you may or may not take in reliance on a message or its content. The limitations of liability set forth in our Terms and Conditions also apply to the Program and are incorporated herein by reference.

13. Governing Law; Disputes; Class-Action Waiver

These SMS Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to the Program or these SMS Terms is subject to the exclusive venue, governing-law, class-action waiver, and limitations-period provisions set forth in our Terms and Conditions, including but not limited to the exclusive venue of the state and federal courts located in Williamson County, Texas.

14. Changes to These SMS Terms

We may modify these SMS Terms at any time by posting an updated version at this URL and updating the "Last Updated" date. Material changes will be communicated through the Site or by text message at least thirty (30) days before they take effect, where required by law. Your continued participation in the Program after the effective date of any change constitutes your acceptance of the updated SMS Terms.
